Wise Market Australia Pty Ltd (ABN: 27 652 305 863) (“we”,” us”, ”our”) operates the wisemkt.com (“marketplace”) and all related subdomains. We provide an online marketplace where you may purchase a range of consumer electronics from one of our sellers. The seller is the third-party organization that advertises, sells, and supplies the devices to you, the buyer.

These terms and conditions govern the access and use of the marketplace. You agree to be bound by the following terms and conditions by registering for and using the marketplace. We may amend these terms and conditions at any time and at our sole discretion. Any new features or tools that are added to the marketplace at any point in the future will also be bound by these terms and conditions; they may be updated or amended to reflect any change in the process. Your continued use of the marketplace constitutes acceptance of any of those changes.

General:

• Your use of the marketplace is subject to an online registration which will capture personal details, including your name, phone number, email address, and delivery address.
• You agree that

• All information provided to us is true and accurate
• You are over the age of 18
• You have the necessary skills to navigate and use the marketplace; You are financially capable of managing payments after completing the transaction via the marketplace
• You are the authorized user of the payment option selected at the checkout on the marketplace
• You may not use our products for any illegal or unauthorized purpose nor violate any laws in your jurisdiction (including but not limited to copyright laws)
• You will not transmit any illicit code/virus/worms or anything else of a destructive nature to the marketplace, any email addresses associated with us or our customers/suppliers
• You will provide us with evidence (should we request such information) to verify the truth and accuracy of the information provided during the registration process
  • You must notify us via email of any changes to be made to your personal information provided during registration
  • We reserve the right to refuse service and terminate your use of our marketplace at any time and for any reason at our sole discretion

• We have certain obligations relating to your personal information detailed in our privacy policy which is available on our website. Our privacy policy does not exempt us from any policies set out by the Federal Government of Australia or any State Government in Australia
• We are obligated to abide by local consumer laws in any jurisdiction where business is conducted – including but not limited to the Australian Consumer Guarantees Act
• We are obligated to keep your personal information safe and secure and ensure that it is not used for any purpose other than what is necessary to complete a transaction through the marketplace
• We may use cookies (electronic tracking) to improve your experience on the marketplace while also sending browsing information back to the company. You may manage how cookies are handled in your browser

• The description of products, including photos, features, specifications, and any other information, are subject to change without notice; however, the description of products relating to a completed sale will not change
• You acknowledge that the weight, size, and dimensions of the products advertised on the marketplace are estimates only and may not be completely accurate
• You acknowledge that the grading criteria described in the marketplace are subjective. While every effort will be made to ensure the grading criteria is universally accepted and described, you acknowledge that the grading criteria described on the marketplace is a guide only and may not reflect the true condition of the device

• The pricing will be updated on the marketplace from time to time. Any indicated price is subject to change without notice
• We will not guarantee or confirm any pricing before an order being completed and an order confirmation provided
• Pricing will not be altered after the sale unless it is discussed and agreed to in writing
• An order will not be confirmed until you have completed the payment through one of the methods offered on the marketplace
• Payment for orders will take place immediately and may be processed by a third party, including but not limited to PayPal, Stripe, AfterPay or ZipPay
• We reserve the right to cancel an order at any time and for any reason. In doing this, we will immediately provide a full refund of the purchase price of the device(s) purchase on the marketplace
• All pricing on the marketplace (unless explicitly stated) includes GST and/or any other local applicable taxes
• The seller will provide you with a tax invoice should you request one. It is at the discretion of the seller whether they provide invoices on every order by default. Any requests for invoices should be directed to our customer service department

• Tracking information will be provided to you after receiving confirmation of the order and within the seller’s dispatch timeframe
• Sellers on the marketplace may have different dispatch timeframes, depending on geographical location
• Any queries relating to the tracking information or related updates should be directed to our customer service department. We will get in touch with the seller on your behalf to confirm those updates
• We do not influence the delivery timeframe once the order has been handed over to the delivery partner. Many things may influence the delivery timeframe, and the delivery timeframe provided to you is an estimate only
• If a parcel is lost in transit, the seller is required to investigate with the delivery partner. If the parcel is deemed to have been lost by the delivery partner after the investigation, a replacement device will be dispatched to you by the seller
• If you have mentioned on the delivery notes to leave without a signature, neither the seller nor we are liable for any lost or stolen packages after the tracking information has been updated to show the parcel as delivered
